Terms of use
Last updated 4 November 2026
These terms cover using this website and what you may do with the photographs on it. The specific terms of a session you book — the fee, the deposit, what happens if it rains — are set out in your booking confirmation, and those take precedence over anything here.
Who you are dealing with
This site is run by Creative Moments. The contact address for anything in these terms is nkcreativemoment@gmail.com.
The photographs are mine
Every photograph on this site is my own work, and I own the copyright in it. Under the Copyright, Designs and Patents Act 1988 that stays with me as the photographer even when you have paid for the session — commissioning a photograph does not transfer its copyright.
That is not me being territorial. It is what lets me show work in a portfolio at all, and it is the standard position across the industry.
What you may do with your photographs
When you buy a session, you get a licence to use the photographs from it as much as you like, forever, for anything personal:
- print them, at any size, anywhere you like
- put them on your walls, in albums, in cards
- post them on social media and send them to whoever you want
- hand copies to your family and your guests
What that licence does not cover:
- selling the photographs, or licensing them to someone else
- commercial or advertising use — if a brand or a publication wants one, ask me and it is usually a yes on fair terms
- entering them in competitions as your own work
- editing them in a way that materially changes the work, then presenting it as mine
A credit is never required for personal use. It is always appreciated.
Photographs you find on this site
Everything in the portfolio is published to be looked at, not taken. Please do not download, repost, crop, reupload or train a model on these images without asking. The same applies to anything in a private gallery you have been given access to that is not of you.
Private galleries
A client gallery link is effectively a key. Anyone who has the link — and the password, where one is set — can see the gallery, so treat it the way you would treat a key.
- Share it with the people it is meant for and no further.
- Galleries are never indexed by search engines and never listed publicly.
- Downloads may be switched off for a particular gallery — if you need them on, ask.
- Galleries have an end date. You will be told before one closes, and reopening it is free.
Bookings and prices
Submitting the booking form is a request, not a confirmed booking. The date is yours once I have confirmed it in writing and any deposit has been paid. Until then it can still go to someone else, and I will tell you if that is about to happen.
Prices shown on this site are for the session only and do not include travel beyond my usual area, prints, albums or framing. I will always quote the full figure in writing before you commit to anything. If a price here is wrong, I will tell you before taking payment rather than hold you to a mistake.
The deposit, the balance, cancellation, rescheduling and what happens in bad weather are all set out in your booking confirmation. Read that document — it is the one that governs your session.
Using this website
Use it normally and there is nothing to worry about. Specifically, please do not try to break into parts of it that are not yours, run automated scrapers against it, or submit the forms repeatedly to cause a nuisance. The forms are rate-limited and persistent attempts get blocked.
I try to keep the site up and correct, but I cannot promise it will never be unavailable or never contain a mistake. If something looks wrong, telling me is genuinely helpful.
Where I limit my responsibility
Nothing here limits my liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow me to limit — and if you are a consumer, your statutory rights under the Consumer Rights Act 2015 are unaffected by anything on this page.
Beyond that: I am not responsible for losses that were not a reasonably foreseeable result of something I did, and my liability for a session is limited to what you paid for it. In the very unlikely event that equipment fails or I am genuinely unable to attend, I will tell you immediately, refund you in full and do what I can to find you another photographer.
Which law applies
These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction. If you are a consumer living elsewhere in the UK, you keep the right to bring a claim in your own local courts.
Changes
I may update these terms. The date at the top tells you when they last changed, and the version in force for your session is the one you were given at the time you booked. See also the privacy policy.
